Anti-Social Behaviour

Waltham Estate RMO acknowledges that there is no one definition of ASB, but it favours the definition as stated in the Crime & Disorder Act 1998:

“Acting in a manner that caused or was likely to cause harassment, alarm or distress to one or more persons not of the same household as themselves”

An equally valid definition is as stated in the Anti-Social Behaviour Act 2003:

“Conduct which is capable of causing nuisance or annoyance to any person and which directly or indirectly relates to, or affects the housing management of a relevant landlord”

Examples of Anti-Social Behaviour include but are not limited to:
Neighbour Problems

These are disputes which can happen between two neighbours and cover complaints about noise; verbal abuse; boundary disputes; harassment and intimidation; nuisance children; car repairs; damage to property, and barking dogs.

Neighbourhood Problems

These problems affect more people living in a neighbourhood such as graffiti; dog fouling; fly tipping; nuisance youths, off-road motor cycling, and abandoned vehicles.

Crime Problems
Such problems include burglary of dwellings; criminal damage, drug dealing; car crime; arson; race and hate related incidents; public order offences; violence against people, and damage to property.

Waltham Estate RMO also has clear prohibitions in its Tenancy Agreement against NUISANCE AND ANTI-SOCIAL BEHAVIOUR.

Hate Crimes

We know that incidents of harassment (also called anti-social behaviour or ASB) and putting people in fear of violence are prohibited by law. This includes verbal and physical abuse or threats, motivated by someone’s age, disability, faith, race or sexual orientation.

  • The RMO employees will support you, treat you with respect, allow you to report an incident in a private safe meeting area. If you request it we will arrange for an officer of the same sex to meet with you, or we will act as a third party to the council’s own Community Safety Officers.
  • Your meeting with us will be treated in the strictest of confidence, and we will maintain and process the data you give us in accordance with our privacy statement and data protection requirements.
  • We will act as a third party reporting centre for Lambeth Council and we will refer your report to the council’s Community Safety Section who will make contact with you within 24 hours of the matter being drawn to their attention.
  • We will work closely with our partner organisations, taking appropriate enforcement action in response to court orders and police action.
  • We will remove any offensive or hate crime graffiti within 24 hours.
  • You can report incidents to the police if in immediate danger – call 999. You can also call the council’s ASB hotline 020 7926 5000.
  • Where we are unable to resolve cases of harassment ourselves, we will work with other agencies to find effective and quick solutions.

Drug Activities

Drug taking is classified as anti-social behavior, and it is a breach of your tenancy conditions and illegal act which has a massive impact on the quality of life of residents and can cause residents distress and puts the health of other residents at risk and is a breach of your tenancy or lease conditions.

Section 22.3 of your tenancy conditions provides, amongst other things, that “You must not do anything which is, or which is intended to, or which is likely to be a nuisance or danger to other people, or which causes damage to our property or the property of our tenants and lessees, their families, lodgers or visitors”.

You should also be aware that under the Misuse of Drugs Act. Possession of any drug classified as A, B, C is an arrestable offence and punishable on conviction by a prison sentence, a fine or both. Your landlord considers that if anyone is proved to be in possession of any of the classified drugs in your flat, this would be grounds for possession under Ground 2 Schedule 2 of the Housing Act 1985.

Your landlord requires that you desist from having and using any illegal drugs in your flat. This means your landlord requires you not to smoke cannabis or drugs dealing in your flat or the communal area at any time.

Waltham Estate RMO and SNT Brixton North Ward Police Team are working in partnership and is committed to and have the right to take extreme action against residents who engage in illegal activities or cause distress to their neighbours.

You are therefore advised to abstain from the use of drugs to avoid strict action against any identified perpetrators.

Domestic violence

Domestic violence is any incident of threatening behaviour, violence or abuse (psychological, physical, sexual, financial or emotional) between adults who are, or who have been, intimate partners or family members, regardless of gender or sexuality.

This definition includes violence such as female genital mutilation (FGM) so-called ‘honour’ crimes, forced marriage, and acts of gender-based violence.We will treat you with support and respect, and allow you to report an incident in a private meeting area at our housing offices, with an officer of the same sex where requested.

  • We will listen to you and your circumstances, not be judgmental or advisory – and enable you to make informed choices about the next steps you want to take.
  • We will enable you to think about next steps by referring you to the partner agencies you need, who can provide a range of emotional and practical support and counseling services.
  • We can give you advice on the housing options and welfare benefits that are available to you depending on how you occupy your property, and what you need to do to take up these options.
  • We will prioritise any repairs needed as a result of domestic violence.
  • Your meeting with us will be treated in the strictest of confidence, and we will maintain and process the data you give us in accordance with our privacy statement and data protection requirements.
  • If you are the sole tenant of your property, and you have excluded a perpetrator from your home with a court order, we can assist you to arrange for additional security where necessary.
  • We will work with our partner agencies and take all necessary enforcement actions as a result of legal verdicts and police actions.
  • We will apply the Respect Standard for local government when dealing with both victims and perpetrators – we will try to find solutions for all parties.
  • We will work with our partners to monitor outcomes and incident rates and will involve residents in improving and publicising our services.

Feeding Pigeons

This is a serious health and safety issue due to the problems it causes to public health.

Feeding pigeons is a breach of the tenancy and lease agreement.

Pigeons are wild birds capable of finding their food. The waste food does not contain the essential vitamins the birds require causing ill health and deformity.

Waltham Estate residents were strongly warned to stop feeding pigeons due to the following reasons:

  • feeding pigeons attracts them to the areas that are not natural to them and exposes them to injury
  • they are especially vulnerable to attack by cats when encouraged to feeding on the ground
  • pigeon droppings are not only unsightly but are acidic and can cause damage to buildings and machinery
  • nesting material, droppings and feathers can block gutters and air vents.
  • feeding results in all year breeding that causes overcrowding
  • The birds become stressed, causing disease and parasites to spread quickly within the flock. This can transfer to humans.

We strongly advise residents not to feed or encourage feeding of pigeons in communal area.

Please feel free to report anyone caught feeding pigeons to the housing office. The information provided will be treated in strict confidence. 

The office will continue to monitor the CCTV cameras to identify perpetrators.
